Adult Hosting Terms:-

All material must be legal within the following countries:- New Zealand and the United States.
Additionally, adult sites must use a warning page to inform both minors and adults that the web site they are about to view contains adult content or material that may offend people.

We will NOT tolerate child pornography, bestiality (sex with animals), rape sites or anything else considered to be illegal material. Pretending to be a "Nudism" based site does not allow you to have images of under age girls/boys on show or protected by password or subscription based software. If you are not sure ASK first.

Sites that violate any of these rules are subject to immediate suspension and/or termination without prior notice and without refund(s). Sexsites New Zealand do not check clients' web sites but we will conduct a full investigation and co-operate with the appropriate officials if a site is suspected to contain any illegal materials, with or without prior notice. 

The following are NOT permitted and a fee of NZ$1000.00 per incident will be charged to the site owner/operator if Sexsites New Zealand receives reports or finds that any of the following terms have been violated. In the case of fraudulent credit card use all IP's are recorded along with the time, this information including the sign-up information used will be passed onto the appropriate Credit Card Fraud Department.

• Child Pornography
• Bestiality (Sex with animals)
• Spamming
• Fraudulent claims/credit card use
• Unlawful use of copyright material
• Illegal material used within the web site or linking to illegal material.
• System resource "hogs" i.e. IRC Bots
• Pirated software
• Viral software and the like
• Deletion or alteration of server files
• Pop-Up Window Loop sites
• Blatant abuse of hosting plan tools such as the control panel, FTP accounts and SSH.

Sexsites New Zealand reserves the right to suspend and/or cancel any web site for any reason without refund(s), their decision is final. Sexsites New Zealand accepts no responsibility for the damage or loss of any customers web site files/images, scripts or databases.
Sexsites New Zealand accepts no responsibility for any loss of revenue/commission or time based money/commission paid to you, your company, business associates or work colleagues due to server downtime or by file/image/database loss or damage.
There will be no further communication or correspondence from Sexsites New Zealand after an account has been terminated, unless it is for overdue fees, in which case we will inform you of the Debt Collectors acting on our behalf.

Hosting Account Termination
All hosting account cancellations must be received in writing by either regular mail or email. Telephone requests do not constitute acceptance of any cancellation, and are no-longer acceptable. Account cancellations must contain the following statement:-
 
"I (your name) wish to terminate my hosting account www.youraccount.com effective as of:- (state date)"
 
along with that we require the original username and password that was assigned to your account. WITHOUT notification of cancellation we will take it that you are still hosting with us and you will continue to be billed for hosting.
PLEASE NOTE: Failure to pay hosting fees can result in accounts being suspended or closed down until invoices are paid in full, the reactivation of suspended accounts incurs a one-off $50.00 fee, the recovery of a suspended or cancelled web site from backups will incur a one-off $150.00 fee. All overdue accounts are passed onto our debt collectors Online Collections. All collection fees and additional costs incurred will be charged to you.

Fees
Monthly hosting fees are due on the 20th of each month, payment is on receipt of invoice, this means you are paying in advance. Invoices are for tax purposes only and if a statement of accounts is required then you'll need to contact us directly. Customers paying by credit card will have their cards automatically debitted for the amount invoiced.

Please note Sexsites New Zealand reserves the right to change prices and hosting plan options without any prior notice.

All credit cards will be debited in New Zealand dollars and customers credit card statements will show Render-Vue as the billing company, hosting accounts are billed on a monthly basis unless you have chosen a 3 monthly or annual contract. Exchange rates are defined by Visa or MasterCard at the time of transaction.

Sexsites New Zealand reserves the right to change the "Rules" without prior notice or warning. Non-enforcement of any part of the "Rules" does not constitute consent.

Amendments as of the 17th September 2007
Unsolicited E-mail, News Bombing (SPAM) Use of the FortressITX/Softlayer/Render-Vue service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Spam complaints will be sent to the e-mail address on file. Violations of this type will result in the immediate suspension of the offending web site on the Render-Vue server. Failure to respond to complaints within a 24 hour timeframe will result in the Render-Vue abuse staff suspending the offending web site or shared hosting account by whatever means necessary. Should the account become re-activated without the express written consent of Render-Vue's Abuse Department, the offending web site or shared hosting account will be immediately terminated, and may result in suspension / termination of the server should the site and/or client re-appear on the server. Anyone hosting web sites or services on their server that support spammers or cause any of FortressITX or Softlayer's IP space to be listed in any of the various Spam Databases will have their server immediately removed from the network. In the event any IP space become listed on any spam lists, clients will be subject to a US$150.00 delisting fee covering our administrative time. Additional costs incurred to be removed from such sites will be subject to both the de-listing cost incurred from some spam list providers as well as additional fees of US$200.00 for a first offense, US$450 for a second offense, and US$600.00 for each additional request. Servers may also become disconnected or the offending IP null routed and the server will not be reconnected until such time that you agree to remove any and all traces of the offending material immediately upon reconnection and agree to allow us access to the server to confirm that all material has been completely removed. Severe violations may result in immediate and permanent removal of the server from the network without notice to the customer. Any server guilty of a second violation will be immediately and permanently removed from the network without notice. Malicious intent to impede another person's use of electronic mail services or news will result in the immediate termination of the offending Render-Vue account.

Network disruptions : Use of the Render-Vue's service for any activity which affects the ability of other people or systems to use Render-Vue's Services or the Internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. Render-Vue will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data. Render-Vue, does not allow the hosting of IRC, IRC Bots, or eggdrops on FortressITX or Softlayer's network. This includes, but is not limited to servers, routers, services, bots, eggdrop bots and bouncers. Servers found hosting this material will be subject to immediate cancellation without refund. Use of the Render-Vue's service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Render-Vue's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending Render-Vue account is subject to immediate termination.
